Results of NCCIR meeting dated 03 April 2018

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 15 positions. The Commission extended the validity of five licenses for operating in telecommunications sector and issued three licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on April 03, 2018.

According to the Commission’s decision, six operators and nine providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, seven economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

NCCIR has adopted the decision to extend the validity (according to the relevant applications of PJSC “Ukrainska zaliznytsia”) of four licenses:

  • for the provision of fixed local telephony with the network capacity of more than 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Donetsk city and Donetsk Oblast from July 17, 2018 till July 16, 2023. It was decided to issue a copy of this license for “Donetska zaliznytsia” the regional branch office of PJSC “Ukrainska zaliznytsia” in the territory of Donetsk city and Donetsk Oblast;
  • for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Luhansk city and Luhansk Oblast from July 17, 2018 till July 16, 2023. It was decided to issue a copy of this license for “Donetska zaliznytsia” the regional branch office of PJSC “Ukrainska zaliznytsia” in the territory of Luhansk city and Luhansk Oblast;
  • for the provision of fixed domestic long distance (DLD) telephony with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Ternopil, Rivne, Volyn, Zakarpattia, Chernivtsi Oblast from July 24, 2018 till July 23, 2023. It was decided to issue a copy of this license for “Lviv zaliznytsia” the regional branch office of PJSC “Ukrainska zaliznytsia” in the territory of Ternopil, Rivne, Volyn, Zakarpattia, Chernivtsi Oblast;
  • for the provision of fixed DLD telephony with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Donetsk city and Donetsk Oblast, Luhansk city and Luhansk Oblast from July 17, 2018 till July 16, 2023. It was decided to issue a copy of this license for “Donetska zaliznytsia” the regional branch office of PJSC “Ukrainska zaliznytsia” in the territory of Donetsk city and Donetsk Oblast, Luhansk city and Luhansk Oblast.

Moreover, the Commission has extended the validity of a license to LLC “AFINA” for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Kherson city and Kherson Oblast from December 05, 2018 till December 04, 2023.

NCCIR has adopted the decision to issue a license for a sole proprietor Harbar S.A. for the use of radio frequency for broadband radio access (a radio data transmission system using noise-shaped signal) within the territory of Khmelnytskyi Oblast.

The Commission issued two licenses for an additional RF bandwidth to:

  • LLC “BERSHNET” – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in Vinnytsia Oblast;
  • Private Enterprise “Tsyfrovi Komunikatsii” – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in Sumy and Zhytomyr Oblast.

Upon examination of the letter of LLC firm “ASHARD” and attached copy of a document, confirming the timeliness of the appeal to NCCIR with the application on the extension of the validity period of the license for the use of radio frequency resource of Ukraine, the Commission cancelled its decision dated February 20, 2018 No. 89 “On refusal to extend the validity of a license for the use of radio frequency resource of Ukraine No. 7240, issued to LLC firm “ASHARD”.

In connection with the failure to provide documents confirming the payment for the issuance of a license for the use of radio frequency resource of Ukraine, in accordance with Part 3 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Commission cancelled the paragraph 1 of NCCIR decision dated February 13, 2018 No. 72 concerning the issuance of license for the use of radio frequency resource of Ukraine for a sole proprietor Svidzinskyi Yu.L.

In connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license, NCCIR has adopted the decision to refuse PJSC “DORIS” in issuance of a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Dnipropetrovsk Oblast.

In connection with the earlier adopted decision on the issuance of a license for a RF bandwidth that is declared, and appeal of NCCIR decision dated 10 January 2017 No. 10 by LLC “SFERAMAKS”, NCCIR has refused Private Enterprise “Tsyfrovi Komunikatsii” in obtaining a license for an additional RF bandwidth for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) within Kirovohrad, Kherson and Mykolaiv Oblast.

In connection with the applicants’ failure to comply with the requirements of part 1 of Article 37 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” and paragraph 3.9 of License provisions for use of radio frequency resource of Ukraine, approved by the NCCR decision dated 19 August 2005 No. 53 and registered at the Ministry of Justice of Ukraine on October 20, 2005 under No. 1237/11517 (concerning the timing of application), Private Enterprise “Firma DAN” was refused in extending the validity of a license for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Rivne Oblast.

According to the licensee’s application, NCCIR has cancelled a license to a Private Enterprise “Novi informatsiini systemy” for the use of radio frequency resource of Ukraine for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Zakarpattia Oblast.

On the basis of documented circumstances that do not allow to start the use of radio frequency resource timely and according to the application from March 12, 2018, the Commission has rescheduled for a Private Enterprise “Beinleumi Ukraina” the starting date of use and full development of radio frequency resource of Ukraine without changing the period of validity of license.

According to the Commission’s decision, 184 new types of facilities were added to “The Register of REFs* and RC**”.

The information about 11 types of radio facility was changed in “The Register of REFs and RC”.

Upon examination of the applications of LLC “Huawei Ukraine” and PP “OTSOP” concerning the possibility of applying the particular type of REFs and RC in the territory of Ukraine, and according to the results of technical expertise on issues of electromagnetic compatibility of declared REF type, NCCIR identified as possible the use of two declared types of radio electronic facilities in the territory of Ukraine.

NCCIR has adopted the decision to allocate for PJSC “VF UKRAINA” a short number 1640 for the organization of “Funeral services” for the use in the mobile communications network with identification codes of mobile communications network 50, 66, 95, 99 in the territory of Kharkiv city (owner of the services – Municipal Enterprise “RYTUAL” of Kharkiv City Council).

The Commission has re-issued six permits to:

  • PJSC “Ukrtelekom” (due to the operator’s need of renumbering when passing from an analogue numbering segment to a digital) – a permit for the use of number resource with the capacity of 3.300 phone numbers for switching on the number resource with the capacity of 3.300 phone numbers in Kramatorsk city (Donetsk Oblast); in the territory of Donetsk city and Donetsk Oblast; and a permit for the use of number resource with the capacity of 2.000 phone numbers for switching on the number resource with the capacity of 2.000 phone numbers in Zhovti Vody city (Dnipropetrovsk Oblast); in the territory of Dnipro city and Dnipropetrovsk Oblast;
  • LLC “LINKOM-3000” (in connection with the extension of the validity period of the license) – a permit for the use of national identification code 895 of destination network in the territory of Dnipropetrovsk Oblast, Dnipro city, Kyiv city and city of Sevastopol;
  • LLC “Mikrokom” (in connection with the extension of the validity period of the license and due to the operator’s need to change the assignment of the number resource) – a permit for the use of the final destination signaling code of SS7 network in Kyiv city; a permit for the use of number resource with the capacity of 1.000 phone numbers in Kyiv city; in connection with the extension of the validity period of the license – a permit for the use of number resource with the capacity of 1.000 phone numbers in Kyiv city.
