Results of NCCIR meeting dated 15 May 2018

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 10 positions. The Commission issued one license, re-issued one license and extended the validity of three licenses for operating in telecommunications sector, also NCCIR issued one license, re-issued four licenses and extended the validity of one license for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on May 15, 2018.

According to the Commission’s decision, four operators and six providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, LLC “FLESHLAN-TELEKOM”, Private Enterprise “Teleorhanizatsiia “Servis Syhnal”, LLC “LOKOM”, LLC “NOVI KOMPIUTERNI INTELEKTUALNI SYSTEMY TA MEREZHI”, LLC “FAIBERKOM” and a sole proprietor Karavaishnikova T.Ie. have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

NCCIR has adopted the decision to issue a license for a term of 5 years to LLC “TV and Radio Company “ENERHIIA” for engineering maintenance and telecom networks operation in the territory of Shchastia city (Novoaidar Raion, Luhansk Oblast).

By the same decision (due to the change of a legal entity’s location), NCCIR has re-issued a license to LLC Bahatoprofilna firma “EKSPRES, LTD” for engineering maintenance and telecom networks operation in the territory of Zaporizhzhia city.

The Commission (according to the licensee’s applications) has extended the validity of licenses to:

  • LLC vyrobnycho-torhovelna firma “Kabelni merezhi kolektyvnoho pryiomu telebachennia” – a license for engineering maintenance and telecom networks operation in the territory of Bakhmut city (Donetsk Oblast) from September 30, 2018 till September 29, 2023;
  • PJSC “Ukrainska zaliznytsia” – a license for the provision of fixed domestic long distance telephony with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Kharkiv city and Kharkiv Oblast, Poltava city and Poltava Oblast, Sumy city and Sumy Oblast from September 05, 2018 till September 04, 2023 and NCCIR has issued a copy of this license for “Pivdenna zaliznytsia” regional branch office of PJSC “Ukrainska zaliznytsia” in the territory of Kharkiv city and Kharkiv Oblast, Poltava city and Poltava Oblast, Sumy city and Sumy Oblast;
  • LLC “INTERNATSIONALNI TELEKOMUNIKATSII” – a license for the provision of fixed domestic long distance telephony with the use of wireless access with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Odesa Oblast, for the provision of fixed international telephony with the use of wireless access with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Ukraine from November 25, 2018 till November 24, 2023.

NCCIR has issued a license to LLC “MAKLAUT, LTD” for the use of radio frequency resource for radio link communication (radio link communication of fixed radio service) for a term of 5 years in the territory of Cherkasy Oblast.

By the same decision, NCCIR has re-issued (according to the economic entities’ applications) four licenses for the use of radio frequency resource to:

  • LLC “EKSPRES, LTD” (due to the change of a legal entity’s location): a license for broadband radio access (a radio data transmission system using noise-shaped signal) with the period of validity till June 25, 2018; a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) with the period of validity till July 06, 2020; a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) with the period of validity till April 04, 2022;
  • PJSC “VF UKRAINA” (due to decrease in the number of regions) a license for digital cellular radio communication of GSM-900 standard in the territory of Kyiv city, Kyiv, Dnipropetrovsk, Zaporizhzhia, Odesa, Lviv, Donetsk, Kharkiv, Poltava, Luhansk, Cherkasy, Mykolaiv, Ivano-Frankivsk, Zakarpattia, Kherson, Vinnytsia, Kirovohrad, Chernivtsi, Ternopil, Khmelnytskyi, Sumy, Chernihiv, Zhytomyr and Rivne Oblast.

Also, the Commission has extended the validity of a license to LLC “MORSKA - KHVYLIA” for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) from September 19, 2018 till September 18, 2023 in the territory of Dnipropetrovsk Oblast.

In accordance with Part 7, Article 34 and paragraph 2, Part 1, Article 34 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, NCCIR has found licenses invalid, which were issued to:

  • LLC Bahatoprofilna firma “EKSPRES, LTD” – a license for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Zaporizhzhia Oblast;
  • LLC “Research and Development Enterprise “Traifl” – a license for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Dnipropetrovsk Oblast.

In connection with the applicants’ failure to comply with a requirements of paragraph 3.7 of License provisions for the use of radio frequency resource of Ukraine, approved by the NCRC decision dated 19 August 2005 No. 53 and registered at the Ministry of Justice of Ukraine on October 20, 2005 under No. 1237/11517, NCCIR has adopted the decision to refuse LLC “Research and Development Enterprise “Traifl” in extending the validity of license for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Dnipropetrovsk Oblast and found this license invalid.

In connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license, a sole proprietor Huk O.I. was refused in issuance of a license for an additional RF bandwidth for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Volyn Oblast.

According to the Commission’s decision, 10 new types of facilities were added to “The Register of REFs* and RCs**”.

The information about 17 types of radio facilities was changed in “The Register of REFs and RC”.

Upon examination of the applications of LLC “Radio Test Standart”, LLC “Zara Ukraine” and LLC “Nokia Solutions and Networks Ukraine” concerning the possibility of applying the particular type of REFs and RC in the territory of Ukraine, and according to the result of technical expertise on issues of electromagnetic compatibility of declared REF type, NCCIR identified as possible the use of five declared types of radio electronic facilities in the territory of Ukraine.
